"OFFICIAL" RULES AND REGULATIONS
TO PLAY: No purchase necessary. The Jerry's Subs & Pizza "You Too Can Appear in a Jerry's Radio Commercial Sweepstakes" ("Sweepstakes") begins on Monday, September 10, 2007 at 12:01 a.m. Eastern Time (ET) and ends on Sunday, March 30, 2008 at 11:59 p.m. ET ("Sweepstakes Period"). Current eCLUB Jerry Members are automatically eligible and entered in the Sweepstakes. There are two ways to enter the Sweepstakes: the Internet Method and the Mail-In Method.
Internet Method: Join eCLUB JERRY to Enter the Sweepstakes! Visit the Jerry's Subs & Pizza website located at http://www.jerrysusa.com/ and click on the "eCLUB" link and follow the instructions.
Mail-In Method: To enter this Sweepstakes by mail, send your name, address, and telephone number to The Jerry's Subs & Pizza "You Too Can Appear in a Jerry's Radio Commercial Sweepstakes" c/o Jerry's Systems, Inc., 15942 Shady Grove Rd., Gaithersburg, Md 20877 and deliver it by U.S. mail during the Sweepstakes period.
Limit of one (1) Sweepstakes entry per person (whether by Internet or mail). Multiple entry forms from the same person will be destroyed. Entrants that submit more than one entry form may be disqualified.
GRAND PRIZE: The once-in-a-lifetime opportunity to participate in a Jerry's Subs & Pizza radio commercial. The suggested retail price of the Grand Prize is approximately Three Hundred Fifty Dollars ($350.00) (plus One Hundred Fifty Dollars ($150.00) in pension and welfare if the Grand Prize winner is a member of a radio broadcasters union). One (1) Grand Prize will be awarded following the Sweepstakes Period. Certain restrictions and conditions may apply. Odds of winning depend on the number of eligible entries received. The Grand Prize is not transferable, redeemable for cash or exchangeable for any other prizes. The duration and content of the winner's participation in the Jerry's Subs & Pizza radio commercial will be at the sole and absolute discretion of Jerry's Systems, Inc. (hereinafter the "Company"). The Company reserves the right in its sole and absolute discretion to substitute a prize of equal or greater value for the Grand Prize published above. The Grand Prize winner is solely responsible for all travel charges, including but not limited to travel to the radio commercial recording facility and for the reporting and payment of any federal, state or local tax liabilities incurred.
ELIGIBILITY: This Sweepstakes is open only to legal residents of Maryland, Virginia, West Virginia, Delaware, Pennsylvania and the District of Columbia, who are 18 years of age or older as of the date of entry. The Sweepstakes is not open to employees of the Company, Jerry's Subs and Pizza or their affiliates, licensees, parents, subsidiaries, divisions, franchisees, advertising and promotion agencies, or members of the immediate family or household of each. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
WINNING: The drawing for the Grand Prize winner will be held on or about Tuesday, April 1, 2008 ("Grand Prize Drawing"). One (1) participant entry will be randomly selected as the Grand Prize Winner from among all from all of the valid eligible entries received in the Sweepstakes during the applicable Sweepstakes Period. The Grand Prize winner will be notified within two (2) business days of the Grand Prize Drawing by overnight mail and/or electronic mail. The Grand Prize winner will have (2) business days from the date of notification of the Grand Prize Drawing to complete, sign, and return to the Company an Affidavit of Eligibility, Release of Liability and Publicity Release. If (i) the Affidavit of Eligibility, Release of Liability and/or Publicity Release is not returned to the Company within (2) business days from the date of notification of the Grand Prize Drawing, (ii) the Grand Prize winner declines to accept the Grand Prize, or (iii) the Grand Prize winner is declared ineligible, that Grand Prize Winner will be disqualified and will forfeit the Grand Prize and a substitute Grand Prize Winner will be randomly selected from the remaining entrants. If the Grand Prize winner is deemed ineligible to collect his/her prize, the prize will be awarded at the Company's discretion. To obtain the name of the Grand Prize winner, send a self-addressed, stamped envelope to Jerry's Systems, Inc., 15942 Shady Grove Road, Gaithersburg, MD 20877 after the Grand Prize Drawing.
LIMITATIONS ON ENTRY: This Sweepstakes is subject to all applicable federal, state and local laws. Void outside Maryland, Virginia, West Virginia, Delaware, Pennsylvania and the District of Columbia or where prohibited. By participating, entrants agree to be bound by these Official Rules and Regulations and the sole and absolute decisions of the Company and waive any right to claim ambiguity in the Sweepstakes or these Official Rules and Regulations. By participating, each Grand Prize winner and entrant also releases, discharges, indemnifies and holds harmless the Company, Jerry's Subs and Pizza and each of their respective owners, managers, officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes. In order to receive the Grand Prize in the Sweepstakes, the winner is not required to purchase any goods or services, pay any money or submit to any sales promotion effort.
The Grand Prize Winner may be required to sign additional waivers and releases in order to receive the Grand Prize. Except where prohibited: (i) acceptance of the Grand Prize constitutes consent to use the Sweepstakes winner's name, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, without further compensation; (ii) the Grand Prize winner may be required to sign an affidavit of eligibility and liability/publicity release; and (iii) the Company may share the information submitted on the entry forms with their affiliates and customers. Failure to permit the Company to publish the Grand Prize winner's information and/or picture will automatically disqualify that winner, who will forfeit the Grand Prize and the Company will randomly choose a substitute winner (who will be subject to all of these Official Rules and Regulations).
CONDUCT AND DECISIONS: By participating in the Sweepstakes, participants agree to be bound by the decisions of the Company's personnel. Persons who violate any rule, gain unfair advantage in participating in the Sweepstakes or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstakes in its sole discretion and the Company's decisions concerning such disputes shall be final. If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference of any event beyond the control of the Company, the Company reserves the right to terminate this Sweepstakes, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS SWEEPSTAKES, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
LIMITATIONS OF LIABILITY: The Company and Jerry's Subs and Pizza are not responsible and assumes no responsibility for late, lost, misdirected, undeliverable, illegible, damaged, incomplete or postage due entries, whether online or otherwise, due to postal errors, system errors or failures, or faulty transmissions or other telecommunications malfunctions and/or online entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, or faulty transmissions, or for any problems or technical malfunction(s) of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, or entries not received by the Company on account of technical problems or traffic congestion on the Internet, or at a Web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from entering the Sweepstakes or downloading any material for the Sweepstakes, or other telecommunications malfunctions which may limit an entrant's ability to participate.
IN NO EVENT WILL THE COMPANY OR JERRY'S SUBS AND PIZZA BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, INDIRECT, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES) ARISING OUT OF THIS SWEEPSTAKES.
